PSC order, Warm Springs Public Service District and Town of Bath dba Berkeley Springs Water Works (26-0672-PSD-W-PC)
Commission Procedural Order that approval of the proposed Water Termination Service Agreement is withheld pending submission of a revised agreement consistent with this Order and further Commission review, the Parties revise Paragraphs 1 and 2 according to the directions stated herein, and the revised agreement expressly assign responsibility for customer notices and the required personal-contact attempts and establish a procedure for documenting and verifying compliance before termination. If Warm Springs undertakes the personal-contact attempts, it shall provide BSWW with written verification identifying the date, method, and outcome of each attempt. All notice and personal-contact provisions shall conform to the applicable Commission rules, including their timing requirements and exceptions; etc.
