PSC final order, Pea Ridge Public Service District and Graham Meadows Service District, Inc. (26-0750-LRR-PSD-S-PC-X)
Commission Final Order that the Commission grants its consent and approval, pursuant to W. Va. Code § 24-2-12, for Pea Ridge Public Service District and Graham Meadows Service District, Inc. to enter into and effectuate the Agreement on Transfer of Remaining Sewer Customers, without specifically approving the individual terms and conditions of the Agreement; that the transfer of all remaining Graham Meadows Service District, Inc. sewer customers to Pea Ridge Public Service District is approved; that, upon initiation of service by Pea Ridge Public Service District, the transferred customers shall be provided sewer service pursuant to Pea Ridge Public Service District’s Commission-approved tariff; that, upon completion of the transfer of its remaining customers and initiation of service to those customers by Pea Ridge Public Service District, Graham Meadows Service District, Inc. may withdraw its sewer tariff pursuant to Rule 18.1 of the Commission’s Rules for the Construction and Filing of Tariffs, 150 C.S.R. 2; that nothing in this Order shall relieve Graham Meadows Service District, Inc. of the abandonment, closure, decommissioning, or other disposition of its sewer facilities or compliance with any applicable legal, environmental, or regulatory requirements; etc. Case Final.
