Commission Final Order that, without specifically approving its terms and conditions, the Commission grants its consent, pursuant to W. Va. Code § 24 2-12, for West Virginia-American Water Company and Kanawha Falls Public Service District to enter into the Interim Emergency Water and Wastewater Operation and Maintenance Agreement; that, pursuant to W. Va. Code § 24-2-12(a), the Commission consents to the interconnection of the West Virginia-American Water Company and Kanawha Falls Public Service District water systems to the extent West Virginia-American Water Company and Kanawha Falls Public Service District determine that an interconnection is necessary prior to Closing; that West Virginia-American Water Company and the Fayette County Commission shall file, as a closed case filing in this proceeding, a copy of any final order entered by the Circuit Court of Fayette County resolving the litigation between E.L. Robinson Engineering Co. and Kanawha Falls Public Service District, within ten days after entry of the final order; that West Virginia-American Water Company and the Fayette County Commission shall file, as closed case filings in this proceeding, evidencing completion of the acquisitions approved by the Commission, within ten days after the applicable closing; that closure of this proceeding shall not relieve any party of the reporting or filing requirements imposed by this Order, which shall continue and remain in effect until satisfied; etc. Case Final.
